An officer recognized him and 'belongings of his that he had seen at prior encounters'

Officers looking for "a suspicious person lurking around the apartment complex and checking the dumpsters near the area" ended up making two arrests.

Last Monday night, May 20, in Florida, somebody living there told officers the person they wanted “was seen by numerous residents checking the trash cans, as well as the laundry room,” the arrest report said, “but he had recently left toward the gas station or near the laundromat.”

The report continued, saying a sergeant found a man and a woman “talking in the back of the gas station,” and when walked toward them to “initiate a consensual encounter,” the woman handed an object to the man, later identified as Dustin Page Dailey.

“After being handed the unknown object, Dailey immediately attempted to conceal the object from [the sergeant] by placing the item next to their belongings, hoping that [the sergeant] would not have noticed.”The sergeant did see, and he considered that “very suspicious in nature” so he started talking to them and the arrest report said he “noticed a black sunglasses case slightly open, containing a clear plastic baggie, which contained a crystal-like substance very consistent with methamphetamine, and a glass pipe containing a burnt residue was also located inside the sunglasses case.

“The sunglasses case was also next to [them] and [their] belongings.”

Dailey and the woman were detained, and, “Due to the crystal-like substance being located, [the sergeant] conducted a search [and] located a coloring book that was underneath the black sunglasses case.”

The woman said the coloring book belonged to her.

Then, another officer “noticed that Dailey had a black zippered bag next to him, and he asked Dailey if the bag belonged to him.”

According to the arrest report, Dailey said it did, and he just found it while “dumpster diving.”

The officer “searched the bag and found belongings of his that he had seen at prior encounters.

“[The officer] opened a container of makeup and saw a small clear plastic baggie continuing a crystal-like substance consistent with methamphetamine.

“The crystal-like substance tested positive for the presence of methamphetamine, and on a calibrated scale, the substance weighed approximately 1.7 grams.”The arrest report also said, “Dailey was in possession of an injectable prescription drug without a prescription.“When asked about the drugs, Dailey denied that it was his and that he did not know where they came from.

“Due to Dailey's own admission that the black bag belonged to him, it was evident that Dailey was in constructive possession of methamphetamine, and enough probable evidence existed for Dailey's arrest.”

That’s when authorities learned Dailey “had four guilty convictions for drug paraphernalia and four prior guilty convictions for possession of a controlled substance (methamphetamine). [And] one prior guilty conviction for possession of a controlled substance (heroin).”

This time, the 48-year-old was charged with possession of methamphetamine and possession of certain drugs without a prescription.

His bond was set at $2,500, and he has not paid it.

As for the woman, she was charged with failure to appear on charges of possession of methamphetamine and possession of drug paraphernalia.
